Losing a loved one is devastating. The grief is often compounded by financial burdens and a lack of response by those at fault to compensate you for your losses. In most cases, the sooner we can analyze the facts of the tragedy, and get our investigators involved, the better. Many times, the entity at fault may disturb evidence that proves negligence. It is nearly always in your best interest to reach out to an Oregon personal injury/wrongful death law firm that you trust, and that has decades of experience handling wrongful death cases
Johnson Johnson Lucas & Middleton has a record of solid success in recovering damages on behalf of people injured and the families of people killed in industrial, factory, and construction accidents. We have represented clients injured in explosions, by exposure to toxic chemicals, by contact with high voltage electrical wires, by defective equipment, by falls, by suffocation, in fires, by scaffold failures, by unguarded saw blades and pinch points, and by the negligence of other workers, to name a few. Throughout Oregon, individuals are affected by industrial and construction accidents and our attorneys are here to represent you. Our attorneys carefully analyze the facts and circumstances of each situation. Faulty installation of equipment or structures, unrealistic and accelerated business schedules, defective parts or products, all comprise components of cases we have successfully resolved on behalf of our clients.
TV sitcoms portray slip and fall injuries as the stuff of slapstick. In real life, sustaining serious or even fatal injuries due to dangerous, unmarked conditions at a business or residence can be tragic. Drowning because of unsecured pools, sexual assaults in poorly lit parking garages and fractures resulting from slipping on wet supermarket floors are all real life, and sadly not uncommon events that often result from negligence.
Johnson Johnson Lucas & Middleton has filed premises liability claims for clients who have been terribly injured. In one case, a commercial painter fell 15 feet from a raised deck onto concrete when an improperly installed guardrail gave way had been installed, and our client leaned against it. In addition to the benefits he received through his workers’ compensation claim, we filed and ultimately settled a “third party” legal claim, an Employers Liability Law claim, and a premises liability claim on his behalf due to the dangerous conditions at the property.
Often the property owner quickly repairs the condition that caused an injury. Consequently, it is important to investigate premises liability claims as soon as possible. In the case involving the painter, for example, the 2 X 4 rail that gave way quickly disappeared and a new railing was installed. Fortunately, we were contacted early and were able to assist in the investigation, preserving smart-phone photographs and interviewing elusive witnesses before they could no longer be found.

Landslides, Mudslides, and Debris Torrents
Johnson Johnson Lucas & Middleton represents the survivors and families of several people killed in the March 2014, Oso, Washington mudslide. Dozens of people lost their lives in that terrible, but foreseeable, event. In association with Washington attorney, Corrie Yackulic, we are currently investigating the causes of the mudslide. We also represented victims of a second debris torrent on Highway 38 that occurred the same day. There a landslide started in a clearcut near a logging road and came down the ravine. It killed one woman and injured several others. Logging and road building also contributed to that devastating landslide. We were able to obtain compensation for the victims of this event.
After the litigation, one of our attorneys was a member of an Oregon state task force that reviewed existing forestry and land use laws and regulations. The task force developed new legislation that allowed the Oregon Department of Forestry to prevent logging on steep high-risk sites above homes and highways. That legislation was enacted by Oregon’s legislature. Today, the Oregon Department of Forestry would not allow such logging to go forward.
Pedestrian accidents are likely to involve very serious injuries or death. Johnson Johnson Lucas & Middleton has handled many pedestrian accident claims for victims and families. We recently represented the French children of a gentleman tourist who was in the United States visiting when he was run over and killed by a distracted driver. In another case, one of our clients, a police officer, was hit by a car when he was picking up debris that had fallen from a scrap metal truck.
